Red Robin Gourmet Burgers’ The Fool for Love Essay Contest ("Contest")
is open to legal residents of the fifty (50)
United States
and the
District of
Columbia
(excluding
Puerto Rico
, all
United States Territories
and Possessions, and all Overseas
Military Installations) who are at least twenty-one (21) years of age as of
January
1, 2008
.
Employees of Funjet Vacations, The Mark Travel Corporation, La Macchia Enterprises,
Inc., officers, directors and employees of Red Robin International, Inc. (“Red Robin,”
“Sponsor,” “we” or “us”), Warner Bros. Entertainment Inc. and their immediate families
and members of each of their households (whether legally related or not), or of
Sponsor’s parent(s), subsidiaries and affiliates, and persons similarly affiliated
with any of Sponsor’s franchisees, as well as the officers, directors and employees
of any advertising, promotional or judging agency affiliated with this Contest,
are not eligible to participate in the Contest.
HOW TO ENTER:
Contest Begins/Ends: The Contest begins as of
January
1, 2008
at
10:00 a.m.
Eastern Time (“ET”) and ends as
of
February 10, 2008
at
11:00
p.m. ET
, according to Sponsor's electronic
time stamp.
The Entry: Each Entry must include the Entrant’s
original essay of one hundred (100) words or fewer (the “Entry”) describing the
Entrant's amazing love story, which must be based on actual events.
The Entry must not have been previously published nor have won a prize in
any other contest. Entries must be in keeping
with Sponsor’s image and may not be offensive, as determined by judges in their
sole discretion, nor may the Entry defame or invade publicity rights or privacy
of any person, living or deceased, or otherwise infringe upon the rights of any
person, group or organization. The Entry
must be an original work of authorship under U. S. Copyright Law. The judges may
disqualify Entries that fail to comply with these Official Rules.
The decisions of judges and Sponsor shall be final and non-appealable in
all matters. The essay must be written in English and may not exceed the one hundred
(100)-word limit. All eligible entries that
meet the Contest criteria and are deemed eligible for entry by Sponsor in Sponsor's
sole discretion must be received no later than
February
10, 2008
at
11:00 p.m. ET
for entry in the contest.
Entries Become the Property of
Sponsor: All Entries
become the sole property of Sponsor. Sponsor
will not acknowledge or return any Entry.
Each Entrant who wins a prize must execute such documents as Sponsor requests, permanently
assigning to Sponsor all copyrights, moral rights and other rights in and to the
Entry.
The Process, Limits: Limit one (1) Entry per person, per
household, per e-mail address. If an Entrant
submits multiple Entries, Sponsor may reject all Entries or judge only the first
Entry that Sponsor receives from the Entrant.
Entries will only be accepted online. Sponsor
reserves the right to cancel or suspend the Contest, in Sponsor's sole discretion,
should Sponsor receive fewer than ten (10) eligible Entries, or receive no Entries
that adequately conform to the judging criteria set forth below.

“Entrant”: Each person who enters the contest
is deemed an “Entrant.” Entrants may be referred
to as “Entrants” or “you.” The Entrant is
the individual whose name appears on the Entry form.
The Entrant is the only person eligible to receive any prize in respect to
the Entry. Only one (1) Entrant’s name may
appear on an Entry form.
PRIZES:
Grand Prize: One (1) Grand Prize Winner will be
awarded the following: One (1) vacation for
two (2) with Funjet Vacations to
Nassau, Bahamas
.
Prize includes round-trip transportation for winner and one (1) guest [from
the closest Continental U.S. airport serviced by United Airlines, United Express,
Ted or Funjet Vacations charter air service] to Nassau, Bahamas, seven (7) nights'
accommodations at the all inclusive RIU Paradise Island and round-trip transportation
between the airport and hotel in Nassau.
The Grand Prize may not be redeemed for cash, nor may the winner demand any substitution
for the Grand Prize as described. The Grand
Prize is non-transferable and, once booked, the dates of travel may not be changed
without the permission of Sponsor and Funjet Vacations.
The Grand Prize trip is subject to availability, restrictions and holiday
blackout dates set by Funjet Vacations. The
Grand Prize trip must be completed no later than
February
28, 2009
.
Approximate retail value ("ARV") of trip is Two Thousand Four Hundred
Ninety-Seven Dollars ($2,497.00) (USD) per person.
Total ARV for both trip packages combined is Four Thousand Nine Hundred Ninety-Four
Dollars ($4,994.00) (USD). Actual value may vary based on airfare fluctuations,
season of travel and distance between point of departure and destination.
All travel arrangements must be made with Sponsor at least forty-five (45)
calendar days in advance of trip. Grand Prize
Winner and one (1) guest must travel together on the same itinerary.
Grand Prize Winner and one (1) guest are solely responsible for obtaining
valid travel documents including but not limited to passports, visas, and required
vaccinations/immunizations as needed or required in advance of travel.
Failure to do so will result in forfeiture of the Grand Prize. Once confirmed,
prize package is non-changeable and has no cash value and frequent flier mileage
may not be accrued. The Grand Prize Winner is solely responsible for all airport
and security taxes including the September 11th security fee, federal, state and
all local taxes. The difference between the ARV and actual value of the prize will
not be awarded. The Grand Prize Winner's travel companion will be required to execute
and return a Liability Release/Publicity Release prior to issuance of the Grand
Prize. All costs and expenses not specified herein are the sole responsibility of
the Grand Prize Winner, including, without limitation, taxes, ground transportation
not specified above, meals not specified above, beverages and gratuities. The Grand
Prize Winner and his/her travel companion are responsible for obtaining travel insurance
(and all other forms of insurance) that they may wish to obtain (at their own expense)
and hereby acknowledge that the Sponsor has not and will not obtain or provide travel
insurance or any other form of insurance. Specifics of all prizes are in Sponsor's
sole discretion. No cash or other substitution may be made, except by Sponsor, who
reserves the right to substitute the Grand Prize with another prize of equal or
greater value if the Grand Prize, or a portion of the Grand Prize, is not available
for any reason as determined by Sponsor in Sponsor's sole discretion. The Grand
Prize Winner is responsible for any taxes and fees associated with receipt or use
of a prize.
Runner-Up Prizes:
Fifty-one (51) Runner-Up Prizes will be awarded: one (1) to the finalist from each
of the fifty (50) states and the
District of
Columbia
.
Each Runner-Up Prize consists of one (1) Two Hundred Dollar ($200.00) (USD)
VISA® Gift Card and
one (1) Fifty
Dollar ($50.00) (USD) Red Robin®
Restaurant Gift Card. Red Robin® Restaurant
Gift cards may only be redeemed at Red Robin® restaurants for goods and services. No cash redemption permitted.
ARV of each Runner-Up Prize is Two Hundred Fifty Dollars ($250.00) (USD).
Total ARV of all prizes is Seventeen
Thousand Seven Hundred Forty-Four Dollars ($17,744.00) (USD).
Prizes consist only of the items listed.
Any portion of a prize not accepted by the winner will be forfeited. Taxes on prize, if any, are the sole responsibility
of the winner. Prize details and availability
are subject to change, in which case a prize of equal value will be substituted
by Sponsor at Sponsor’s sole discretion.
Prizes are non-transferable, with no cash redemption value or substitutions permitted
except at Sponsor’s sole discretion. Sponsor
will award prizes “as is” with no warranty or guarantee, either express or implied.
WINNER SELECTION/JUDGING CRITERIA:
Essays will be judged by an independent judging firm who will select at least fifty-one
(51) finalists (one from each state and the
District of
Columbia
).
Odds of winning depend upon the number of eligible entries received. Members
of the Red Robin Marketing Department will select the potential Grand Prize Winner
from those fifty-one (51) finalists. The
Entry judged to be the most amazing love story will be chosen as the potential Grand
Prize Winner. An alternate finalist from
the state or
District of
Columbia
whose finalist is declared the
potential Grand Prize Winner, will be declared the Runner-Up Winner from that state
or
District of Columbia
.
Entries will be judged in equal value based on: 33.33% = originality, 33.33%
= creativity and 33.33% = sincerity. The
Grand Prize Winner and fifty-one (51) Runner-Up Prize Winners will be determined
on or about
Friday,
February 22, 2008
.
Decisions of the judges and Red Robin’s representatives shall be binding, final
and unappealable. Sponsor reserves the right
to award fewer prizes than indicated if there are insufficient qualifying Entries
to award all available prizes.
WINNER NOTIFICATION/RELEASES/COPYRIGHT
ASSIGNMENT: Sponsor will attempt to contact potential winners
via email or overnight mail or courier within five (5) business days of judging. Potential winners may be required to complete,
sign, notarize and return an Affidavit of Eligibility, Liability and (where permitted)
Publicity Release and an assignment of the copyright as to their Essay within seven
(7) business days of notification or the prize may be forfeited.
Travel companion of Grand Prize Winner (or parent or legal guardian, if travel
companion is a minor) must also complete, sign and return a Liability and (where
permitted) Publicity Release within the same time period.
Any prize or prize notification returned as undeliverable or refused will
result in the potential winner being disqualified and Sponsor may select an alternate
potential winner. A potential winner must
comply with all terms and conditions of these Official Rules, and winning is contingent
upon fulfilling all requirements. A potential winner must respond to the notification
e-mail within the timeframe stated in the notification e-mail and provide his/her
full name, age and mailing address. Failure of a potential winner to provide this
information within the stated timeframe will result in forfeiture of the prize.
By accepting a prize, Winners consent (except where prohibited by law) to Sponsor’s
use of the Winner’s name, likeness, photograph, biographical information and statements
in advertising, promotional materials and on its web sites without notice or compensation.
GENERAL RULES:
1. Entries may not infringe on the rights
of any third party. By participating, each
Entrant (a) assumes all liability for any injury or damage caused or claimed to
be caused by Entrant’s participation in the Contest and/or the acceptance, possession,
use or misuse of any prize and/or travel, and (b) Entrant releases and holds harmless
Sponsor and Warner Bros. Entertainment Inc., The Mark Travel Corporation, Funjet
Vacations, and their respective parent companies,
subsidiaries and franchisees, and their respective officers, directors, employees
and agents, from and against any and all claims based on publicity rights, defamation
or invasion of privacy, or violation of intellectual property rights, including
copyright or trademark infringement.
2. Sponsor may announce Winners’ names
and addresses to the public, and provide Winners’ names and addresses to government
agencies, as required by law. Sponsor may provide any information that Entrants’
and Winners’ provide to Sponsor to Sponsor’s employees and to independent contractors
that Sponsor may engage to administer any aspect of this Contest or to serve as
judges, and to government agencies, if required by law. Except as indicated above,
Sponsor will treat all personally identifiable information of Entrants and winners
as confidential, and will not sell Entrant’s or winner’s personally identifiable
information to any other company, group or person.

3. Neither Sponsor, Funjet Vacations,
The Mark Travel Corporation, La Macchia Enterprises, Inc., Warner Bros. Entertainment
Inc. nor their respective parent companies, subsidiaries, franchisees of each, nor
their respective officers, directors, employees or agents (collectively, "Released
Parties") are responsible for lost, late, stolen, misdirected, damaged, incomplete
or garbled entries. Entries void if mechanically
reproduced, defective, altered, forged or submitted through or outside authorized
channels, made through robotic, automatic, mechanical, facsimile, programmed or
similar entry duplication method, and Sponsor reserves the right to disqualify any
individual using such method. Released Parties
and their respective parent companies, subsidiaries, franchisees of each, and their
respective officers, directors, employees and agents are not responsible for any:
(a) telephone, computers or network malfunction, human or other error or failure
to properly process any Entry; (b) communication disruption or other forces beyond
their reasonable control, including inability to access any website, submit an Entry
or other disruption related to internet traffic, virus, bug or any unauthorized
intervention whether or not caused by any action(s), regulation(s), order(s), or
request(s) by any governmental or quasi-governmental entity(ies), equipment failure,
including overloading of the Website due to excessive use, threatened terrorist
act(s), terrorist act(s), air raid(s), blackout(s), act(s) of public enemy, earthquake(s),
war(s) (declared or undeclared), fire(s), flood(s), epidemic(s), explosion(s), unusually
severe weather, hurricane(s), embargo(s), labor dispute(s) or strike(s) (whether
legal or illegal), labor or material shortage(s), transportation interruption(s)
of any kind, work slow-down(s), civil disturbance(s), insurrection(s), riot(s),
or any other similar or dissimilar cause(s) beyond Sponsor’s sole and reasonable
control; (c) damage caused by computer virus or otherwise resulting to any computers
from Entrant’s access to the Contest website or Entry into the Contest; (d) printing
or other errors appearing in the rules or other Contest materials; (e) injury or
damage to persons or property which may be caused, directly or indirectly, in whole
or in part, from any Entrants participation in the Contest or receipt or use of
any prize. Released Parties shall not be responsible for any cancellations, delays,
diversions or substitutions or any act or omissions whatsoever by any performer(s)/event(s),
air carrier(s), hotel(s), or other transportation companies or any other persons
providing any of these services and accommodations to passengers including any results
thereof such as changes in services or accommodations necessitated by same. The
passenger contracts in use by the airlines or other transportation companies shall
constitute the sole contracts with respect to the Grand Prize Winner's and his/her
travel companion transportation and such contracts shall be solely between the Grand
Prize Winner, his/her travel companion and such transportation companies. Released
Parties shall not be parties to such contracts and shall assume no responsibility
in this connection. Released Parties shall not be liable for any loss or damage
to baggage or the loss, theft or damage of cash, cameras, jewelry, securities, heirlooms,
negotiable papers or other valuables. If the Grand Prize Winner becomes disabled
or cannot otherwise fully enjoy the Grand Prize package due to illness, Sponsor
shall have the option of: (1) being relieved of liability for fulfillment of the
Grand Prize award; or (2) at Sponsor's sole discretion extending the period during
which such prize may be awarded for a period equal to the duration of the Grand
Prize Winner's disability or illness, in which case certain prize components may
not be available. The Grand Prize Winner must prove such disability by a doctor's
certificate, which certificate shall be endorsed by another physician agreeable
to Sponsor and Grand Prize Winner at Sponsor's expense. Sponsor's failure to enforce
any term of these Official Rules shall not constitute a waiver of that provision;
Entrants further agree that in any cause of action, the Released Parties' liability
will be limited to the cost of entering and participating in the Contest, and in
no event shall the Released Parties be liable for attorneys' fees and/or experts'
fees and costs. Entrants waive the right to claim any damages whatsoever, including,
but not limited to, punitive, consequential, direct, or indirect damages..
If any malfunction, error, disruption or damage occurs which impairs the
administration, security, fairness, integrity or proper play of the Contest, Sponsor
may, in its sole discretion, suspend or terminate the Contest by posting a notice
on www.redrobin.com.
4. Persons found tampering with or abusing
any aspect of this Contest, or whom Sponsor believes to be causing malfunction,
error, disruption, damage or impairing the administration, security, fairness, integrity
or proper play of the Contest will be disqualified.
In the event that the operation,
security, or administration of the Contest is impaired in any way for any reason,
including, but not limited to fraud, virus, or other technical problem, the Sponsor
may, in Sponsor's sole discretion, either: (a) suspend the Contest to address the
impairment and then resume the Contest in a manner that best conforms to the spirit
of these Official Rules; or (b) award the prizes from among the eligible entries
received up to the time of the impairment. Sponsor reserves the right in Sponsor's
sole discretion to disqualify any individual that Sponsor finds to be acting in
violation of these Official Rules or in an unsportsmanlike or disruptive manner.
Any attempt by any person to undermine the legitimate operation of the Contest may
be a violation of criminal and civil law, and, should such an attempt be made, Sponsor
reserves the right to seek damages from any such person to the fullest extent permitted
by law. Sponsor's failure to enforce any term of these Official Rules shall not
constitute a waiver of that provision. In case of a dispute as to the owner of an
online entry, online entry will be deemed to have been submitted by the authorized
account holder of the e-mail address from which the entry is made. The "authorized
account holder" is the natural person assigned an e-mail address by an Internet
access provider, online service provider or other organization responsible for assigning
e-mail addresses for the domain associated with the submitted address. A potential
winner may be required to provide Sponsor with satisfactory proof that s/he is the
authorized account holder of the e-mail address associated with the potential winning
entry.
5. By entering
this Sweepstakes, all entrants agree that Sponsor has the right in Sponsor's sole
discretion to decide all matters and disputes arising from the Contest. Sponsor's
determination of the winner is final and binding. The laws of the State of
Wisconsin
apply to and govern this Contest
and any claims must be raised and resolved in the Federal or state courts located
in
Milwaukee, Wisconsin
.
